Mr. D.K. was driving in the middle of the night by himself and was heading home. A police Duty Inspector followed Mr. D.K. for about 18 kilometres before pulling Mr. D.K. over. The Duty Inspector then arrested Mr. D.K. for impaired driving with the assistance of two tactical officers.
Jake made request to the Crown and asked for all disclosure. Once Jake received the materials, it was clear to Jake that D.K.’s driving was quite normal. Upon further investigation, Jake learned that the duty Inspector suspected D.K. of being a drug dealer as he was driving a rental car in the middle of the night. The Inspector followed D.K. for 18 kilometres was for the two tactical officers to catch up, so the police could do
a take-down. The Duty Inspector never had any concerns about D.K.’s driving. The claim of the impaired driving was just an excuse for police to search D.K.’s vehicle for drugs.
The Crown agreed to withdraw Mr. D.K.’s impaired charges.
